By registering, accessing, or using any part of the WeighVi website, application, or services (the "Platform"), you agree to abide by these Terms, our Privacy Policy, and any applicable laws or regulations.

2. Platform Purpose

WeighVi provides health and nutrition tracking services, including AI-assisted tools to support wellness goals. The Platform is intended for personal, non-commercial use.

3. Prohibited Conduct

You agree not to misuse the Platform. Prohibited activities include, but are not limited to:

• Hacking, reverse-engineering, or exploiting vulnerabilities in the Platform.
• Automating interactions, such as using bots, scrapers, or scripts.
• Disrupting services, interfering with platform performance, or conducting any form of denial of service (DoS).
• Uploading malicious content, such as malware or spyware.
• Accessing accounts that are not yours or impersonating others.
• Violating any applicable laws or regulations while using the Platform.

Violations may result in account suspension, termination, legal action, and potential civil or criminal penalties under applicable laws.

4. Account Suspension and Termination

Prestige Affiliates, LLC reserves the right to:

• Terminate or suspend any account at any time, with or without notice.
• Cancel active subscriptions at our sole discretion.
• Restrict or revoke access to AI features or other services for any reason, including suspected abuse or violation of these Terms.

5. Modifications to the Terms or Platform

We reserve the right to update or modify these Terms and the Platform at any time, without prior notice. Continued use of WeighVi constitutes your acceptance of any changes.

6. Subscription Services

Paid features of WeighVi may be provided via subscription. Subscriptions may be canceled by you at any time. However, no refunds will be issued for unused time unless required by law.

We reserve the right to alter subscription plans, pricing, or features at any time.

7. Data Usage & Monitoring

By using the Platform, you acknowledge and agree:

• We may monitor usage patterns to improve services and detect abuse.
• Your data may be processed by third-party providers, including OpenAI, to power AI features.
• You accept and agree to our Privacy Policy, which governs how we handle your personal data.

8. Arbitration and Governing Law

Any dispute arising from or relating to your use of WeighVi shall be resolved exclusively through binding arbitration, in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall occur in New York, and will be governed by the laws of the State of New York, without regard to its conflict of law principles.

By using WeighVi, you waive your right to participate in class actions, jury trials, or any other legal proceedings outside of arbitration.

9. Limitation of Liability

WeighVi and Prestige Affiliates, LLC shall not be held liable for any indirect, incidental, consequential, or punitive damages arising from use of the Platform, including but not limited to health decisions made based on Platform suggestions.

All services are provided "as-is" without warranties of any kind, express or implied.

10. Severability

If any part of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
